Dr Mahathir rebukes Jais for disrupting Hindu wedding (4 June 2014)

Tun Dr Mahathir Mohamad today rebuked the Selangor Islamic authorities for intruding upon a Hindu wedding ceremony at a temple during the weekend, saying the action went against the teachings of the Quran.

The former prime minister said the Selangor Islamic Affairs Department (Jais) should study the Quran and find out how to handle the situation.

"This type of incidents originates from not adhering to the teachings of the Quran," Dr Mahathir told a press conference at the International Islamic University Malaysia in Gombak.

"The Quran gives us full guidance on how to lead our lives. That is why Islam is described as a way of life."

He even says in another post, "I have been accused of being anti-Hadith, and I have also been called a kafir (infidel). Apparently, all Umno people are infidels,"

Muslim woman who married a Hindu refuses to back down (4 June 2014)
http://www.themalaysianinsider.com/malaysia/article/muslim-woman-who-married-a-hindu-refuses-to-back-down

For the last seven years, Zarinah Abdul Majid had been making frequent trips to the Shariah Court and the National Registration Department (NRD) hoping to remove the word "Islam" from her identity card, as she is not a practising Muslim.

She said she spent thousands of ringgit hiring lawyers to help but it was all in vain.

Zarinah (pic) then took a bold step – she decided she was going to marry the man of her dreams, a Hindu – and that too, in a temple on Sunday.

"I was not afraid any more. I was fed up and could not wait any longer. I am getting old and I want a family of my own," she told The Malaysian Insider, speaking in Tamil.

On Sunday, the 32-year-old factory worker had the "thali" tied around the neck by her boyfriend of seven years, in a traditional Hindu wedding ceremony in a temple in Petaling Jaya.

She had invited 400 guests and spent more than RM30,000 on the ceremony and the reception that followed.

But the reception did not go as planned as enforcement officers from the Selangor Islamic Religious Department (Jais), accompanied by policemen, took her away to question her about her religious status.

"Most of my guests were shocked and obviously, they left without eating. It was so embarrassing and painful," she told The Malaysian Insider.

The Malaysian Hindu Sangam, Bar Council, Hindu Rights Action Force (Hindraf) and civil society condemned Jais and the police for "trespassing" into the temple and disrupting the ceremony.

Zarinah was released later but she told The Malaysian Insider that she was not backing down.

"Although I carry a Muslim name, I am a practising Hindu. I also follow the customs and culture strictly," she said in a telephone interview.

Zarinah said her parents who were Hindus were married in 1980. The father was known as S. Mahendran and mother, S. Vasandamma.

"Later, my father was converted to Islam by a relative and he carried the Muslim name, Abdul Majid," she said.

Zarinah said her mother remained a Hindu.

She said as a result, she and three other siblings were identified as Muslims in their birth certificates and MyKad.

Zarinah said after the birth of her brother in 1990, their father left the home and never returned.

"My mother did not realise that we were Muslims because she is illiterate. But the family only practised the Hindu faith," said Zarinah, who lived with her family in Sungai Way.

Zarinah said over the last 20 years, the family members had seen many lawyers to find a solution to their problem but it turned out to be an exercise in futility.

"We would have spent about RM20,000 in legal fees alone but nothing has changed. On paper, we are still Muslims," she said, sounding disappointed.

Zarinah said she met her husband seven years ago and made another attempt to get out of this quagmire.

From the little knowledge she gained from the lawyers she had met and advice from friends, Zarinah went to the Shariah Court to get an order to renounce the faith.

"I was told that the court has to issue a certificate for NRD to delete the word Islam in the identity card," she said.

"All I can say was that I was given the run around by the officials and it was frustrating at times.”

Zarinah said she could not register her marriage under civil law for as long the word "Muslim" appeared in the MyKad.

She finally decided to go through the traditional wedding as "age was catching up and I want have a family".

"My husband managed to tie the 'thali' to signify that we are married," said Zarinah who was dressed in a saree before she was taken away by Jais officials to Shah Alam for questioning.

She was freed about 2pm after her statement was recorded.

Zarinah said her guests were shocked.

"Even my Muslims friends privately confided that what happened in the temple was uncalled for as Jais officials could have called me in for questioning later.”

Zarinah said she knew the culprit who tipped off the authorities about the marriage ceremony but added it could be a blessing in disguise.

"All this while, I was fighting a losing battle to exert my rights which many people did not know. I hope justice will now be done since my problem has now gone public."

I spent so much money and time working on this problem and now they are telling me to do the same thing.

Meanwhile, Jais had denied raiding or disrupting Zarinah's wedding ceremony.

Deputy director-general of Jais Ahmad Zaki Arshad said they were only investigating complaints from the public and took a statement from the bride to ascertain her religious status.

He said the department had followed proper procedures.

"This was not a raid or an operation. We only conducted routine checks and asked the IC holder whether she is a Muslim," he told The Malaysian Insider.

Zarinah said Jais told her to change her name and religion to avoid being dragged to court for apostasy.

"But that was what I was trying to do for years. I spent so much money and time working on this problem and now they are telling me to do the same thing."

Zarinah said there was a possibility that she could be charged with insulting Islam if the problem was not solved quickly. – June 4, 2014.

In Malaysia, Balotelli is Iranian and Rafael Nadal is Muslim (TMI)

http://www.themalaysianinsider.com/malaysia/article/in-malaysia-balotelli-is-iranian-and-rafael-nadal-is-muslim

3 June 2014

There is some perverse logic working in Malaysia.

In the very early days of the flight MH370 saga, the civil aviation chief had used footballer Mario Balotelli's name and likeness to describe how two Iranians managed to use stolen passports belonging to Europeans to pass through Malaysian immigration.

Of course, nobody understood what he was trying to say then, and assumed that those holding the stolen passports looked like Balotelli. Or that the civil aviation chief thinks Balotelli is Iranian, not Italian.

But what can we say about Selangor Islamic Religious Department (Jais) deputy director-general Ahmad Zaki Arshad who justified his department's operations to check if a bride at a Hindu wedding ceremony this past week is actually a Muslim.

He said that they had to investigate but not necessarily punish anyone just because an individual has a Muslim name.

"For example, if Rafael Nadal comes to Malaysia and goes to a church, we have to investigate because he has a Muslim name. So please do not jump to conclusions," he said in referring to the world number one Spanish tennis player.

As it is, the United States conducts stricter checks on people who have Muslim-sounding names due to terrorism fears, Malaysia might as well follow suit but to keep these people's faith intact. After all, our flags are similar.

Why would anyone think that Rafael Nadal is a Muslim name? Would we then have to assume that the actress Salma Hayek is a Muslim too?

Or for that matter, Colombian pop star Shakira?

Wouldn't it scare away tourists or any other visitors if the Islamic authorities are suspicious of anyone whose name remotely sounds Muslim, or to be precise Arabic, and that they have to investigate and verify their faith?

Especially as it is Visit Malaysia Year 2014, which has already been hit by the flight MH370 disappearance. Do we want to hassle people because of their name?

As it is, the United States conducts stricter checks on people who have Muslim-sounding names due to terrorism fears, Malaysia might as well follow suit but to keep these people's faith intact. After all, our flags are similar.

There must be some perverse logic to Ahmad Zaki presuming that Nadal is a Muslim-sounding name. Because it is just plain ridiculous.

Religious enforcers should spend more time ensuring Muslims have a better life instead of working on connecting names to a person's faith. Or would that be asking too much from them? – June 3, 2014.

Muslim bride at Hindu wedding should change religious status, says Jais (MalaysiaMailOnline)

3 June 2014

KUALA LUMPUR, June 3 ― The Muslim bride at a Hindu wedding that was stopped by the Selangor Islamic Religious Department (Jais) recently should apply to formally change her status if it were true that she had never practised the religion, the state authority said.

Jais deputy Director Ahmad Zaki Arshad was quoted as saying in Harian Metro that it was best that the bride, Zarena Abdul Majid, appoint a lawyer and submit an application to change her name and religion, while they investigate the case of her unilateral conversion by her absent father.

Ahmad Zaki noted that contrary to earlier news reports, the case is not being investigated for apostasy.

“What has happened is that the woman and her siblings use Muslim names, but have never practised or were exposed to Islamic teachings as they should have,” he told the Malay daily.

Ahmad Zaki, however, said that Jais has categorised the case under Section 10 of the Syariah Criminal Enactment (Selangor) 1995, for insulting or bringing disrepute to Islam.

Zarena, who was briefly detained by religious authorities two days ago, said in the news report that her father had secretly converted her and her siblings to Islam when they were children.

The 32-year-old claimed that he abandoned them after he divorced her Hindu mother more than 20 years ago.

It was earlier reported that Zarena was brought in for questioning by Jais after the religious authorities stopped her Hindu wedding ceremony at a temple in Shah Alam on Sunday.

Zarena had claimed then that her father had converted to Islam without informing the family and changed his name from Mahendran to Abdul Majid.

He then registered Zarena and her brother as Muslims and kept their documents even after the divorce, she added.

Top Cop Liable for Contempt of Court If Police Refuse to Find Deepa’s Son (TMI)

their feet in their search for the boy. – The Malaysian Insider pic, June 2, 2014.

Police can be held in contempt of court if they refuse to comply with a judge’s order to assist a woman to locate her son abducted by her convert ex-husband two months ago, lawyers said.

They said the police, as a law enforcement agency, must act to execute the order without delay to enjoy public confidence.

Refusal to act on the order obtained by clerk S. Deepa against her estranged husband Izwan Abdullah would only send a wrong message that police were selective when it came to inter-religious conflicts, they said, referring to police inaction to find Deepa's son, V. Mithran

The child was abducted by Izwan from her home in Jelebu on April 9.
The High Court in Seremban had two days earlier granted custody of the couple's two children (Mithran and Sharmila) to Deepa on the grounds that the marriage had been solemnised under civil law.

After converting the children, Izwan also obtained a custody order from a Shariah Court in Seremban.

Deepa's lawyers had handed over a copy of the sealed court order to Bukit Aman on May 23 but police said they would seek legal advice from the Attorney-General's Chambers.

Lawyer Abd Shukor Ahmad said police must help Deepa to enforce the order that came from a competent authority.

"The police cannot hide behind religious sentiments as the confusion whether the civil court had authority over a Shariah Court has been clarified," he said.

The High Court in Ipoh ruled last Friday that any custody order given by a religious court was illegal when one spouse is a non-Muslim.

He said while there were spouses who used conversion to gain custody of their children, the police must give effect to a court order.

"Deepa's effort of going to court to get a remedy will only remain a paper judgment if the police folded their arms and did nothing.”

Civil rights lawyer Syahredzan Johan said the police could apply to set aside the order if they did not want to locate Izwan and return the boy to Deepa.

"It is a court directive which the police must follow or else they are in contempt," he said.

Syahredzan said the public would form a negative opinion of police as law enforcers must be seen as neutral in race and religious matters.

Another lawyer Fahri Azzat, who shared Syaredzan's view, said there was nothing wrong if the police wanted to seek the legal opinion of the A-G's Chambers.

"However, police must assist the mother in enforcing the order if information had been given on the exact location of Izwan,” he said, adding that the possibility of the law enforcer being hauled up for
contempt of court could not be ruled out.

Lawyers for Liberty executive director Eric Paulsen said police inaction revealed that the enforcement agency had no respect for the rule of law or the need to uphold it.

"Police have failed to act to enforce Deepa's right and her access to justice has been denied."

Paulsen said this episode was a manifestation that extreme form of Islamisation was taking root in Malaysia and non-Muslims were defenceless.

He said in future, non-Muslims might decide not to go to court and those who have the resources would run away with their children or go into hiding because a custody battle was not worth fighting.

"The prime minister must take note of this incident or else this will eventually destroy this country." – June 2, 2014.

Hindraf: Jais raid on Hindu wedding unlawful (2 Jun 2014)
http://www.freemalaysiatoday.com/category/nation/2014/06/02/hindraf-jais-raid-on-hindu-wedding-unlawful/

PETALING JAYA: The NGO Hindraf has accused the Selangor Islamic Religious Affairs Department (Jais) of conducting an unlawful and unconstitutional raid on a wedding reception that was being held in a Hindu temple.

“This action by Jais clearly shows disrespect to the sensitivities of non-Muslims and their place of worship. They clearly crossed the boundaries of their jurisdiction,” said Hindraf chief, P Waythamoorthy.

“The overzealous attitude by the Jais officers shows that they are given a free hand to interfere into the personal life of a non-Muslim individual and they seem to have impunity from the law.

“The absolute arbitrary power of these Jais officers to interfere into the non-Muslim affairs needs to be stopped immediately.

“There is a clear infringement of Article 11 of the supreme law of this country as seen in this matter.”
Yesterday Jais stopped a Hindu wedding in Petaling Jaya and detained the 32 year old bride.

Jais are investigating the case under the 1988 Enactment (Control of Propagation Amongst Muslims), which cites it as an offense to persuade, influence or incite any Muslim to change their faith.

According to a Jais official, the bride’s identity card identifies her as a Muslim.

“The woman did not know that her father had registered her and three of her siblings as Muslims.
“She only found out when a relative saw their birth certificates,” the unnamed Jais official was quoted as saying in a Malay news daily yesterday.

Her father, who had abandoned her a long time ago, had been responsible for registering her as a Muslim but she was raised and grew up as a Hindu.

She said that she had gone to the National Registration Department (NRD) to make a change on the religious status in her MyKad, once in 2007 and again last April.

She failed on both attempts as she was unable to obtain her father’s signature.
