GEORGE TOWN, Aug 27, 2014:

A Year One pupil is now afraid to go to school after claiming to have been slapped by a teacher for being rowdy and not paying attention in class.

The slap appeared to have left finger marks on his right cheek.

The incident yesterday had gone unnoticed until his mother had fetched him after school at 1.25pm and saw what resembled “slap marks” on her son’s right cheek and confronted the teacher.

The two teachers in Penang who were involved in the controversy surrounding a Form Five student who allegedly "liked" a pro-Israel page on Facebook are not being let off the hook yet, despite apologising to the student's family.

They have been asked to report to the Penang education department next week and explain themselves.

The teachers on Friday apologised to the student's family for making the incident public on Facebook and openly condemning the boy.

Education department director Osman Hussain, however, said that was not the end of it.
"They will have to give me an explanation each for their actions, and to state reasons why they should not be transferred out to another school.

"If a teacher fails to follow the SOP (standard operating procedures) in solving a problem, he or she can be transferred out," he told The Malaysian Insider today.

The first teacher posted about her student liking the “I Love Israel” page on her own Facebook page, which soon attracted other Facebook users to condemn and threaten the boy online.

The second teacher posted a comment that the 17-year-old should be boycotted for supporting Israel.

Osman confirmed that both teachers apologised to the boy and his parents yesterday during a meeting held at the school in Taman Tasek Mutiara, Simpang Ampat, on mainland Penang.

"The apology was just one way of resolving this. The two teachers still have to see me next week and give me their explanations."

He said both teachers violated the civil service general order, which states that civil servants are not allowed to make public statements or talk to the media about their work without authorisation.

He said making a statement about their work, or in this case their student, openly on a  social network site is considered a violation of the general order.

"What they did is considered wrong and with that, the department can already take disciplinary action against them. But we are still using our discretion here.

"If this goes into their records permanently, their career advancement chances can be jeopardised," he said.

He said it is important that the incident concerning the teachers be dealt with seriously, as he feared that it could also affect unity.

"We must make sure our teachers understand that they are not to discuss or circulate comments about their work and their students publicly, no matter how good or bad their students are. If they have something to say, do it in school.

"We want this to be a lesson and an example to other teachers so something like this will not happen again... If teachers want to use Facebook, then they should refrain from posting about work and student-related matters."

The teenager learned that he had received threats, including one that suggested he should be burned, after his teacher posted on her Facebook about his alleged “like”.

He lodged a police report about it, saying he never “liked” the pro-Israel Facebook page and did not know what had happened.

After word of what he allegedly did on Facebook got around, the boy was afraid to return to school.

When he did, he found himself shunned by some of his schoolmates and teachers for a few days.

The teen is being investigated for sedition, while those who threatened him on Facebook are probed for criminal intimidation. – August 16, 2014.

KUALA LUMPUR, Aug 15, 2014:

Human Rights Commission of Malaysia (Suhakam) is appalled that a mere Facebook “like” has led police to investigate a 17-year-old student under the Sedition Act.

Its chairman Tan Sri Hasmy Agam, in a press statement today, also blasted the teacher from a school in Penang, who on Aug 10 had taken a screenshot of the boy for ‘liking’ a pro-Israeli Facebook page and uploading it onto the social media without his permission.

This led to threats being issued against the student.

“Suhakam is of the view that the reported sedition probe into the student is an overreaction on the part of the police.
“It is unfortunate to note that the teachers concerned had failed to handle the matter responsibly as educators and instead, created a situation that has violated the basic rights of the student, contrary to the spirit and articles of the Convention on the Rights of the Child, to which Malaysia is a State Party.”

Hasmy said this particular case was an example of how the act could be misused as the matter could be resolved through other approaches.

He went on to call upon all relevant authorities to weigh their actions accordingly and to use their discretion appropriately in the handling of matters that concerned the social media and the expression of various views and opinions.
Hasmy then urged the Education Ministry to incorporate human rights as part of the school curriculum to better promote respect, understanding and acceptance of the basic rights of all citizens, including those of students.

“We also urge all parties to practice restraint and not to partake in any actions that promote ignorance and hatred,” he said, adding that Malaysians should instead strive to exercise respect and tolerance for one another.

Earlier today, Penang police chief Datuk Wira Abdul Rahim Hanafi confirmed that the teenager was being probed under Section 41 (1)(c) of the Sedition Act, and not the case as reported yesterday.

Last week, the Form Five student lodged a police report that his life was threatened by teachers and students of his school for having ‘liked’ the page.

The student had also claimed that a female teacher had cut and paste a screenshot of his ‘liking’ on her Facebook account and ridiculed him, leading to one teacher to suggest, albeit jokingly, to burn the student alive.

NIBONG TEBAL, Aug 13 — A Form Five student who was threatened with immolation for allegedly liking an “I love Israel” Facebook page is now under investigation for sedition.
The 17-year-old who sought police aid two days ago was called in for questioning today by the South Seberang Perai police.
“We are investigating him under Section 4 (1) (a) of the Sedition Act,” Penang police chief Datuk Abdul Rahim Hanafi told reporters at the South Seberang Perai district police headquarters Hari Raya open house here.
“In his statement, he claimed that he had accidentally clicked ‘like’ on the page,” he said, referring to the teen’s recorded statement.
Abdul Rahim added that the police had questioned yesterday a teacher from the same school as the student who had allegedly linked the teen to the “I love Israel” Facebook page.
The sedition law prescribes a maximum fine of RM5,000 or a jail sentence of three years for a convicted first-time offender, or both, and raises the jail term to five years for subsequent offences.
The fifth former filed a police report after a teacher from his school allegedly circulated a screen captured image of the controversial post, which prompted attacks from other Facebook users to cut off ties with the student and to “boycott”.
Another teacher purportedly from the same school, went a step further, leaving on the first teacher’s Facebook page that is accessible only to friends a message that read: “Kita bakor je hahaha [We just burn hahaha]”.
South Seberang Perai district police chief ACP Shafein Mamat said more teachers and students from the boy’s school will be called to give their statements.
“We are investigating both aspects, one of him liking the controversial page and another on the threats against him,” Shafein said.

MCA has criticised the Penang police over its unnecessary investigation into a case involving a Form Five student under the Sedition Act.

Calling it totally ridiculous, the party’s Religious Harmony Bureau chairman Datuk Ti Lian Ker said the public expected the police to investigate the teachers involved in publicising the incident for inciting physical violence against the student as this could have led to murder, disfigurement and injuries.

“While the bureau notes that the Penang Education Department has taken measures to give a warning to the teachers who had implored that the teenager, who had accidentally clicked ‘like’ on the ‘I love Israel’ Facebook page, be burnt alive, we are taken aback that police have questioned the student under Section 4 (1) (a) of the Sedition Act.

“This investigation is totally ridiculous, more so coming from the police in Penang, which has a Jewish cemetery believed to be the oldest in Asia. It will further erode the image of the authorities among the public,” he said in a statement today.

Ti said that the sedition probe against the 17-year-old begs the question if any entity, be it tangible or intangible with the word “Israel” in it, will be deemed seditious.

“For example, will those, including children carollers, singing the chorus for the Christmas carol The First Noel, which ends with Born is the King of Israel, also be subject to questioning under the Sedition Act?

“Will radio and television channels broadcasting The First Noel in its programmes or movie channels also be probed for sedition?”

Ti said such action by the police against a top scholar only added to the victimisation of the student and the perception, whether real or imagined, by non-Muslims regarding selective persecution of religious minorities.

He also expressed concern over the earlier report by The Rakyat Post where schoolmates of the teenager were reported to be bullying and spitting at him in school while another student was beaten up over a mistaken identity.

“MCA’s fears that the teachers’ call to burn the boy will lead to victimisation appear to be coming true.”

He said the authorities should instead focus on never instigating violence and harassment.

He said while MCA wholeheartedly opposed the atrocities committed by the Zionist regime against Palestinian Muslims and Christians on the Gaza Strip, it urged the authorities and educators to practise common sense and not misuse the boycott call against McDonald’s and Starbucks and resort to vigilantism..

The Aug 10 incident led a teacher to screen capture and upload the image depicting the boy’s liking of an “I love Israel” page without the boy’s consent.

Two other teachers commented, calling for a boycott over the student, with one suggesting to burn the boy alive.
