Kewajipan membayar zakat bagi yang berkemampuan sudah termaktub dalam rukun Islam iaitu rukun yang keempat di mana zakat tersebut layak diterima oleh lapan golongan asnaf seperti yang disyariatkan oleh Islam. Berdasarkan statistik negara juga menunjukkan bahawa kaum Melayu yang menganut Islam masih mendominasi kemiskinan di negara kita berbanding kaum-kaum lain. Lihat saja golongan gelandangan, golongan meminta sedekah terutama di kota raya, rata-ratanya ialah kaum Melayu dan beragama Islam. Persoalannya dimanakah pengagihan wang zakat yang disalurkan kepada mereka yang selayaknya? Persatuan Mahasiswa Universiti Malaya (PMUM) berpendirian sudah tiba masanya zakat perlu diauditkan. Antara sebab dan musababnya ialah? [Integriti] Rakyat Malaysia memberikan keyakinan mereka terhadap badan zakat untuk menguruskan duit kutipan zakat, namun begitu sering terpampang di dada-dada akhbar bahawa masih ramai golongan asnaf yang belum menerima hak mereka. Hal ini terbukti daripada laman web kerajaan menyatakan golongan miskin tegar dari masyarakat Melayu paling tinggi iaitu 1.1 % berbanding masyarakat Cina dan India iaitu 0.1% dan 0.3%. Pada tahun 2012 sahaja, orang Melayu mendominasi tahap kemiskinan negara sebanyak 64.8% dan selebihnya adalah kaum lain. Ini menimbulkan persoalan di kalangan golongan Muslim terutamanya terhadap sejauh manakah ketelusan badan zakat dalam menguruskan pengagihan wang zakat. Timbul juga pelbagai persoalan antaranya tentang kelayakan yang perlu ada pada badan yang bertanggungjawab dalam menguruskan hal ini, berapakah jumlah wang zakat yang sepatutnya disalurkan? Siapakah yang sepatutnya layak menerima wang zakat? Bagaimanakah proses golongan asnaf dalam menerima wang zakat tersebut? Dan sebagainya. Sesungguhnya Islam melarang penganutnya daripada melakukan amalan yang tidak bermoral kerana ini akan menjadi punca kepada penindasan rakyat miskin.
Ketelusan
Dalam proses-proses yang dijalankan oleh pihak bertanggungjawab, perlu adanya dokumen-dokumen rasmi dan dokumen ini perlu disemak serta diuar-uarkan kepada masyarakat umum. Proses ketulusan ini perlu dilaksanakan agar tidak timbul lagi persoalan di kalangan rakyat dan persepsi buruk kepada badan zakat. Proses ini juga melambangkan ketelusan pihak yang bertanggungjawab menguruskan urusan zakat ini.
Solusi
Secara izharnya, di peringkat PMUM mencadangkan, kutipan wang zakat di negara kita perlu diaudit oleh pihak yang berintegeriti sebagai contoh Jabatan Audit Negara dimana dengan mewujudkan satu jawatankuasa baru dalam menguruskan hal zakat seperti mana ekonomi negara diaudit oleh Jabatan Audit Negara.
Kesimpulannya
Solusi yang diberikan oleh pihak PMUM ini sedikit sebanyak mampu mengurangkan kadar kemiskinan terutamanya orang islam sendiri, disamping memastikan ketulusan dan integiriti dapat diwujudkan dalam organisasi yang menguruskan pungutan zakat ini. – 20 Julai, 2014.

Court releases documents on Malaysian soldier in NZ sexual assault case - The Malaysian Insider

The New Zealand Herald, citing a report in Newstalk ZB, said according to the released documents, a police request to lift defence staff assistant Muhammad Rizalman Ismail's bail conditions was granted a week before he left New Zealand. The removal of the bail conditions allowed Rizalman to have possession of his passport and to apply for travel documentation, the daily said after a judge granted Newstalk ZB access to court records in the case. According to the New Zealand Herald, court records on May 15 noted that: "At the request of police, bail conditions are removed – (Rizalman) now at large. Issue as to whether defendant has diplomatic immunity being looked into”. On May 22, Rizalman flew back to Malaysia and on May 29, an email from police to court officials noted that Rizalman had left New Zealand, the paper reported. "The New Zealand authorities had no lawful powers to prevent Rizalman's departure," the New Zealand Herald said, quoting from the email. Rizalman, a Second Warrant officer attached to the Malaysian High Commission in Wellington, is accused of following a 21-year-old woman home and assaulting her with intent to rape. It was reported that on May 9, Rizalman had allegedly followed the woman from a bus stop to her Brooklyn house before breaking in and undressing himself. The woman fought him off and neighbours came to her aid. The woman, who has been identified as Tania Billingsley after she asked the court to lift an order to suppress her name, had said in a media interview that she felt frustrated and angry when Rizalman was allowed to go back to Malaysia. Rizalman, 38, was arrested on May 9 for sexual assault and burglary. It was reported that he was currently undergoing a second round of psychiatric evaluation at a military hospital in Kuala Lumpur. The Malaysian government had said that Rizalman would be sent back to New Zealand to face the charges against him but so far no date had been fixed as doctors were still ascertaining his condition, saying that he appeared to be withdrawn and depressed. – July 11, 2014. - See more at: http://ift.tt/1qPo3PX

Will gov’t give firm date on Rizalman’s extradition?

I feel this ‘still undergoing treatment’ excuse will only escalate New Zealand’s and general public’s suspicion of cover-up by the Malaysian government. Anifah or Hishammuddin should announce the actual extradition date. Check with the hospital the psychiatric treatment schedule and the conditions that are considered ‘ready’ for military attache Muhammad Rizalman Ismail’s extradition and release this information to all concerned parties. The Defence and Foreign Ministries need to be very sincere, clean and clear on this matter. After all, Malaysia’s reputation is at stake here. Appum: Now we are all confused. Who makes the decision in this case? This soldier is under the Defence Ministry. The foreign minister has told the people of Malaysia that the government has decided to repatriate this man back to NZ to face trial there since the alleged incident had occurred there. It was even reported that he was to go on Monday. Now we hear the army chief says he is not ready to go. Now for once, who is calling the shots? Why is psychiatric assessment is now presented as a reason when this event had occurred more than a month ago? Don't we think he should be sent for psychiatric assessment right from the beginning when he returned earlier (if that is SOP)? Magnus: Section 5(c) of the Armed a Forces Act 1972 says that an officer or serviceman can be seconded to a department of the federal government, a state, local authority, statutory authority or an organisation in or outside Malaysia and that the secondee remains a member of the regular forces during that period of secondment. However, the secondee's remuneration during the secondment period is paid by the employer to whose service the person is seconded to. That means the army and Defence Ministry have effective joint employment and management control of the alleged attempted rapist in question and not the Foreign Ministry which merely paid his salary and presumably had immediate control over the day-to-day duties and affairs the secondee dealt with at the high commission in New Zealand. There is a psychiatric evaluation process to be done first as defined in the 1972 Act to gauge if the officer is of sound mind to be court-martialled. Section 88(3) lists types of civil offences and sanctions that can be handed out by a military court. The civil offences of treason and murder are liable to suffer death or any other punishment provided for by the Act; the sentence for manslaughter and rape is potential imprisonment (but not exceeding 14 years as in section 89) or any less punishment provided by the Act; other civil offences are potentially liable to suffer punishments which a civil court could award for the corresponding civil offence. There are also other punishments that can be handed out simultaneously, like dismissal with/without disgrace, forfeiture of seniority of rank etc. So if not discharged, then the alleged rapist could get the maximum prison sentence for the burglary, assault and attempted rape if the court martial finds him guilty as now charged by the Kiwis. Anon1: Well, at least he won't get the option of pleading the defence of insanity during the trial in NZ. Our government is ensuring that he is mentally fit to stand trial. But wait, if he is a certified nut case, then the government will not waive the diplomatic immunity and send him back. Fernz: Has he always been undergoing psychiatric treatment? If not, only a court can order psychiatric treatment for an accused. Insanity is a legal definition, not a medical one, and can only be made by a court. Odysseus: Why do you need the attorney-general to work out a date? Just buy a one-way ticket to NZ and inform the Foreign Ministry there. They will welcome him with open arms. Even provide police escort from the door step of the plane. Proarte: This scandal is a window into the modus operandi of Umno governance. Cover-up, lies, false promises, seeking immunity for theft and sexual crimes, and abuse of governmental institutions. It is also playing out the dangerous Umno narrative of 'Ketuanan Melayu' and 'Ketuanan Islam'. Earlier there was talk of extradition 'after Ramadan' now there is further delay due to 'psychiatric assessment'. If all suspected criminals were treated like Rizalman, there will be no convictions and the country would be in total chaos. After the MH370 tragedy, one would have thought the Malaysian government would try to improve its totally battered international image, but it seems systemic corruption is now an unresolvable reality for Umno. It needs corruption to survive but it is this cancer which will surely destroy Umno as well. Kit P: This is getting ridiculous. May 6 until today (July 10), he is still going through "psychiatric tests?" The earlier cover-up attempt by the Malaysian High Commission was wrong. Malaysiakini dilarang lagi daripada membuat liputan di Pejabat Perdana Menteri (PMO) di Putrajaya hari ini.
Larangan itu yang kedua dalam tempoh dua minggu.
Portal berita itu berada di sana untuk membuat liputan sidang media Perdana Menteri Datuk Seri Najib Razak pada jam 10 pagi, seperti diumumkan oleh agensi berita nasional Bernama semalam.
Pihak dilarang termasuk wartawan dan jurugambar Malaysiakiniserta wartawan penyiaran KiniTV, anak syarikat Malaysiakini.
Wartawan-wartawan ini disoal mewakili media mana semasa proses pendaftaran di tempat masuk ke PMO dan dimaklumkan bahawa Malaysiakini tan The Malaysian Insider tidak dibenarkan masuk.
Ketika diberitahu bahawa Malaysiakini dibenarkan masuk ke tempat sama pada Jumaat lalu, seorang pegawai menegaskan larangan itu bermula pada hari ini.

Malaysiakini dilarang lagi daripada membuat liputan di Pejabat Perdana Menteri (PMO) di Putrajaya hari ini.
Larangan itu yang kedua dalam tempoh dua minggu.
Portal berita itu berada di sana untuk membuat liputan sidang media Perdana Menteri Datuk Seri Najib Razak pada jam 10 pagi, seperti diumumkan oleh agensi berita nasional Bernama semalam.
Pihak dilarang termasuk wartawan dan jurugambar Malaysiakiniserta wartawan penyiaran KiniTV, anak syarikat Malaysiakini.
Wartawan-wartawan ini disoal mewakili media mana semasa proses pendaftaran di tempat masuk ke PMO dan dimaklumkan bahawa Malaysiakini tan The Malaysian Insider tidak dibenarkan masuk.
Ketika diberitahu bahawa Malaysiakini dibenarkan masuk ke tempat sama pada Jumaat lalu, seorang pegawai menegaskan larangan itu bermula pada hari ini.

PKR today linked a prominent corporate businessman with links to Umno as the latest recipient of a build-and-rent concession agreement for a Universiti Teknologi Mara ( UiTM) campus in Puncak Alam, Selangor.
In continuing with his daily expose on the construction of six UiTM campuses nationwide, Rafizi Ramli (pic) ( PKR - Pandan) said Tan Sri Rozali Ismail's subsidiary TRIplc Ventures Sdn Bhd has been given the contract to construct the campus.
TRIplc is a company 100% owned by TRIplc Berhad, a public listed company where at least 43% of the shares were controlled either by Rozali, his family and individuals close to him.
"This strengthen my stand that the construction of UiTM Puncak Alam have been given to a company controlled by Rozali, an Umno-linked businessman and among those who had benefitted from his connections with Umno," he said at a press conference at the Parliament lobby today. – June 18, 2014.

LAPORAN AUDIT Ketua Audit Negara mendapati Jabatan Penyiaran Malaysia didapati membuat perolehan berjumlah RM111.30 juta tanpa sebarang kontrak formal.
Perkara itu didedahkan dalam Laporan Audit Negara 2013 siri ke-2 yang dibentangkan di parlimen hari ini.
Laporan itu menyebut, arahan perbendaharaan menetapkan bahawa kontrak formal perlu dibuat bagi perolehan melebihi RM50,000 untuk memastikan kepentingan Kerajaan terjamin.
"Semakan Audit terhadap 426 program (rancangan televisyen) mendapati 413 program berjumlah RM111.30 juta tidak mempunyai kontrak formal.
"KKMM berpendapat SST (Surat Setuju Terima) yang digunapakai memadai untuk menggantikan kontrak formal sebagai ikatan antara kerajaan dengan pembekal.
"Akibat ketiadaan kontrak formal boleh menyebabkan kepentingan Kerajaan di dalam perolehan ini tidak terjamin," laporan audit dipetik.

The Broadcasting Department agreed to RM111.3 million worth of deals without inking any formal contracts.
The second series of the 2013 Auditor General Report found that the department, formerly known as Radio Televison Malaysia (RTM), of the total 426 television programmes, 413 of them did not have a formal contract.
The programmes were for TVi, a new interactive channel launched in April 2011.
This was done despite a Treasury regulation that requires formal contracts for deals worth more than RM50,000.
Instead, the national broadcaster only relied on letters of acceptance (SST) as legal documents.
"The lack of formal contracts can affect the government's interests in procurements, making it not guaranteed," said the report.
The report also noted that RTM entered a three-year tie-up with satellite broadcaster Astro without any formal contract.
The agreement, from 2012 to this year, was to have TVi on Astro in exchange for promoting the satellite broadcaster's NJOY package on RTM's television and radio channels.
"This will affect the government's interests if any misuderstanding should arise.”
The audit found RTM had overcommitted itself by RM21.79 million for the 426 programmes via direct negotiations although the approved budget was for RM90.04 million.
Moreover, the report noted that RTM failed to impose Liquidated Ascertained Damages (LAD) totalling RM182.142 for 42 programmes which exceeded the validity period of their contracts.
"The audit found that 42 programmes which were found to be late between 24 and 217 days were not levied any penalties," it said.
In its reply, the Communications and Multimedia Ministry said it would utilise a formal contract at its procurement board meetings.
It will also ink a formal agreement with Astro to ensure TVi can continue to be broadcast on the satellite channel, and the contract is expected to be signed before or on June 30. – June 16, 2014.
