'People centered' Asean must respect indigenous communities

At a forum session on April 22, JOAS deputy chairperson Sabariah Yusri said that “political control” over their communities is often exerted through the Orang Asli Affairs Department (JAKAO) - a government agency tasked to manage their affairs.

Putrajaya must adhere to Fed Constitution on native lands

KOTA KINABALU: Jaringan Orang Asal SeMalaysia (JOAS) together with human rights group SUARAM and Asia Indigenous Peopls Pact (AIPP), today called for the federal government to immediately undertake necessary policy reforms to recognize and protect the land and forest rights of indigenous people as its contribution to solutions towards climate change.

JOAS, which represents 87 local community organizatons across Malaysia, said the federal government should use  protections contained in Artcle 161 (a)(5) of the Federal Consttuton as the basis to recognize customary land rights.

Making the call in conjunction with International Day of Forests today, JOAS president Thomas Jalong said: “Forests are integral to the survival and source of livelihoods and culture of indigenous peoples. They are our identtes.

“On the Internatonal Day of Forests, we call for the recogniton of the land rights of indigenous peoples as key to the forest-based solutons to climate change.”

JOAS also detailed its other demands in a statement issued here.

These demands include:

• Immediately implement in partnership with indigenous peoples and other stakeholders the Commitee on World Food Security (CFS) and FAO Voluntary Guidelines on the responsible governance of tenure of land, fsheries and forests in the context of natonal food security.

• Adhere to terms of procedures laid down in treates, laws, regulatons and guidelines such as in certfcaton schemes like the Roundtable on Sustainable Palm Oil (RSPO), the Malaysian Timber Certfcaton Scheme (MTCS), Forest Stewardship Council (FSC), Forest Law Enforcement, Governance and Trade Voluntary Partnership Agreement (VPA-FLEGT), and the Business Council for Sustainability and Responsibility Malaysia (BCSRM).

• Guarantee the implementaton of Free, Prior and Informed Consent (FPIC) on any climate change mitgaton acton involving forests such as the REDD+, biofuel plantatons and large dams.

• Ensure full and efectve partcipaton of indigenous peoples including indigenous women and youth in the formulaton, implementaton, monitoring and reportng of any forest-related mitgaton programmes and projects at all levels. • Recognize and promote indigenous peoples’ traditonal knowledge, traditonal occupatons and food systems including the roles and contributons of indigenous women.

• Adopt all the recommendatons in the SUHAKAM Natonal Inquiry into the Land Rights of the Orang Asal.

Meanwhile AIPP secretary-general Joan Carling said there was an  “urgent” need to upscale the recogniton of the forest rights of indigenous peoples.

“Governments can do this through the demarcation and proper implementaton of laws recognizing the collectve land rights of indigenous peoples.

“Securing indigenous peoples’ customary land rights and sustainable livelihoods is necessary for the success of forest-based solutons to climate change and for sustainable development,”  she said.

Newsflash:  The Court of Appeal this morning affirmed that the Common Law is still part of the Malaysian body of law and that it is superior to specific statutes. The panel of 3 judges also held that the High Court judge in case of Kampung Mengkapor did not fully consider all the evidence, including oral tradition, when she made her judgment against the Semaq Beri plaintiffs. They then ordered a re-trial of the case to be heard by a different judge. More to follow.

Kes Semaq Beri di Kampung Mengkapor diarah oleh Mahkamah Rayuan supaya dibicara semula di Makhamah Tinggi Kuantan didepan hakim baru. Mahkamah Rayuan juga memutuskan bahawa bukti secara lisan patut diterima di makhamah tinggi untuk menunjukkan sejarah dan bukti kewujudan tanah adat Orang Asli.

Disamping itu panel tiga hakim Makhamah Rayuan itu mengiktiraf bahawa Common Law masih di amali di Malaysia dan patut diambilkira dalam sistem perundangan kita.

Mahkamah Rayuan hari ini mengesahkan yang Orang Asli di Semenanjung mempunyai hak mengikut undang-undang ke atas tanah pusaka mereka

Panel tiga hakim sebulat suara bersetuju mengenepikan keputusan mahkamah tinggi yang menolak hak 82 Orang Asli Kampung Mengkapur di Pahang ke atas tanah nenek moyang mereka, seluas 7,000 ekar antara Maran dan Kuantan.

Hakim Datuk Dr Prasad Abraham yang membacakan penghakiman berkata, panel hakim berpendapat dua keputusan mahkamah rayuan terdahulu betul dalam menyatakan prinsip undang-undang mengenai hak Orang Asli.

Beliau bagaimanapun berkata, kes Yebet Saman dan 81 yang lain dari suku kaum Semaq Beri ini akan didengar semula seorang hakim baru kerana bukti berkaitan status tanah itu tidak jelas.

Katanya, mereka perlu membuktikan yang mereka memang benar Orang Asli; mereka berterusan tinggal di tanah itu; dan mereka mengekalkan hubungan tradisi dengan hartanah itu bagi mendapatkan hak adat itu. – 28 November, 2014.

Villagers won't move out from dam area

KUCHING: Residents of three Bidayuh villages affected by the Bengoh dam project said the government has no right to evict them because it is customary land and belonged to the natives.

The villagers from Kampung Rejoi Nyegol, Kampung Bojong Siting and Kampung Sait-Muk Ayun said the land could not be used for business.

Villagers’ representative Tawet Anak Sanyok said the affected villagers had the right to live on their own customary land.

“We are not under the influence of opposition political parties,” he said in a press statement today.

Tawet said the villagers had never accepted the Sarawak government’s compensation to move out.

“When the construction of the dam started in 2009, we built our villages outside the dam’s perimeters.

“Kampung Sait-Muk Ayun villagers agreed to move out in 2012 but were unable to do so because the Bengoh Resettlement Scheme was not completed,” he said.

Tawet said the clearing work for the dam would only be completed in 2015.






Penduduk Iban dapat kembali tanah NCR

KUCHING: Mahkamah Tinggi mengisytiharkan pemilik tanah Iban di Kampung Spaoh, Kpg. Menat Ulu dan Kpg. Menat di Gedong, Simunjan mempunyai hak ke atas tanah adat Orang Asal (NCR) dimana tanah tersebut telah diberi oleh kerajaan kepada beberapa syarikat melalui pajakan sementara dan pengeluaran lesen hutan.

Dalam menyampaikan keputusan terbabit kelmarin, Hakim Lee Heng Chiong memberikan perintah pengisytiharan bahawa pemilik tanah ini, yang merupakan plaintif dalam saman itu memperolehi tanah NCR yang mereka tuntut.

Mahkamah Tinggu turut mengarahkan kos RM50,000 dibayar oleh defendan kepada plaintif.

Pemilik-pemilik tanah memfailkan kenyataan tuntutan sejak tahun 2007.

Defendan ialah Penguasa Tanah dan Ukur Bahagian Samarahan, Pengarah Perhutanan Sarawak dan kerajaan negeri.

Syarikat-syarikat terbabit memohon diri untuk menolak saman itu dan permohonan mereka dibenarkan.

Menurut tuntutan kenyataan, pemilik tanah berkata tanah NCR telah diwujudkan oleh nenek moyang mereka sejak dahulu lagi bahkan sebelum Rajah Putih datang ke Sarawak.

Nenek moyang mereka telah menetap di tanah-tanah NCR dan cara tradisional mereka ialah mengumpul hasil hutan untuk menghasilkan barang dan makanan seperti rotan, papan, herba, pucuk, cendawan dan tumbuh-tumbuhan yang boleh dimakan.

Orang Iban bergantung kepada sungai untuk sumber protein dan juga sebagai sumber pendapatan tunai harian

Mereka turut mendakwa bahawa hak menduduki tanah NCR tersebut telah diiktiraf oleh defendan kerana mereka dan/atau ibu bapa mereka telah diberikan subsidi getah di bawah Jabatan Pertanian untuk menanam pokok-pokok getah dari tahun 1966 hingga 1970.

Sebahagian besar tanah NCR tersebut adalah untuk tanaman getah.

Orang Asal bergantung kepada sungai sebagai sumber pendapatan tunai harian

Pemilik-pemilik tanah bergantung kepada kawasan hutan bagi mendapatkan sumber utama seperti ‘Pulau Galau’ (pulau-pulau kecil hutan dipelihara) sebagai sumber bahan perumahan, herba, sayur-sayuran semula jadi yang menjana pendapatan tunai harian.

Mereka juga bergantung kepada sungai untuk sumber utama ikan sebagai makanan protein dan juga sebagai sumber pendapatan.

Peguam See Chee How dan Desmond Kho mewakili pemilik tanah manakala kerajaan negeri diwakili oleh Penasihat Peguam Kerajaan Nur Azhar Bujang dan Rima Ellani Farizuani Kalana.
