(Foreigner in Sabah suppose to be given Identity Card if they have lived in Malaysia for many years and lived in the way how local people live.)

Laporan RCI Sabah dibentang sesi Parlimen ini 29 Oct 2014 Menteri Dalam Negeri Datuk Seri Ahmad Zahid Hamidi berkata laporan Suruhanjaya Siasatan Diraja (RCI) mengenai pendatang asing Sabah yang dimulakan pada 2012 bakal dibentangkan tidak lama lagi. Semasa menjawab soalan Marcus Mojigoh (BN-Putatan) di Dewan Rakyat hari ini, Zahid berkata siasatan itu telahpun lengkap dan bakal dibentangkan sama ada oleh beliau sendiri atau pengerusi RCI itu dalam sesi Parlimen kali ini. Menurut beliau, penyelesaian masalah pendatang asing dan mereka yang tidak mempunyai negara akan dibentangkan dalam laporan itu. SAYA DIARAH SEMBUNYI MASALAH PENDATANG ASING, KATA PAIRIN KEPADA RCI

Bekas Timbalan Ketua Menteri Sabah Tan Sri Joseph Pairin Kitingan maklum tentang masalah pendatang asing di Sabah sejak 1970-an namun ditegah oleh partinya, Parti Bersatu Rakyat Jelata Sabah (Berjaya) untuk membawa isu berkenaan kepada umum.

"Saya menjelaskan masalah itu adalah di bawah urusan kerajaan persekutuan dan merekalah yang harus menyelesaikan isu itu," jelas Pairin kepada lima panel inkuiri.

Saksi yang ke 199 itu berkata sebaik beliau pulang ke Sabah, beliau telah diingatkan oleh pemimpin atasan Parti Berjaya. Pada ketika itu, Pairin merupakan pembantu kepada setiausaha agung parti yang diketuai oleh Tan Sri Harris Mohd Salleh dan Ketua Menteri Sabah ketika itu dari 1976 hingga 1985.

"Saya tidak pasti sebab saya diperingatkan sedemikian namun difahamkan isu pendatang asing yang diberikan kad pengenalan yang kemudian diarah untuk merahsiakannya," kata ahli politik veteran itu kepada RCI.

"Pendatang asing membanjiri Sabah tanpa sebarang dokumen dan mengundang pelbagai masalah kepada penduduk tempatan. Mereka merampas pekerjaan warga tempatan, merusuh di sesetengah tempat di Kota Kinabalu dan mencalar imej negeri," kata Pairin.

KUALA LUMPUR, Aug 14 — A Sabah church called on the National Registration Department (NRD) today to rectify the problem of Bumiputera Christians with “bin” or “binti” in their names being wrongly classified as Muslims in their MyKads.

Sidang Injil Borneo (SIB) Sabah president Rev Datuk Jerry Dusing said the church lodged a complaint with NRD two years ago for 162 such cases in Sabah, but was told that no further action could be taken because the files were lost.

“The JPN must desist from this Islamisation drive through changing the religious status in the MyKad of these Christians,” Dusing said in a statement today, using the Malay acronym for the NRD.

“We also wish to call on the authorities to rein in aggressive Islamisation in Sabah by overzealous ‘dakwah’ (evangelistic) elements from the peninsula through conversion by dubious means such as intimidation, inducement and deception,” he added.

Dusing said the wrong classification of Christians as Muslims in their MyKads has prevented them from getting married legally, which in turn prevented the registration of the birth of their children, as well as the children’s registration in schools and applications for their own identity cards.

“They have also been told by JPN that the department would only rectify their religious status if they went to the Shariah Court to get a declaration that they are not Muslims. It is most ludicrous to subject Christians to the dictates of the Shariah Court,” he said.

Dusing stressed on Sabahans’ right to freedom of religion that Sabah Catholic Archbishop John Wong had raised at the mamangkis gathering organised by the Perpaduan Anak Negeri (PAN) Sabah in Papar last Saturday.

“As we prepare to celebrate the 51st anniversary of the formation of Malaysia on 16 September, we wish to remind the government that the cornerstone of Sabah’s 20-point conditions to the Malaysia Agreement is anchored on freedom of religion,” he said.

News reports surfaced last January of Borneo natives being coerced and duped into embracing Islam, leading Christian group PAN Sabah to accuse Muslim extremists from the peninsula of oppressing Bumiputera Christians in the East Malaysian state.

In the so-called Project IC, which was investigated by a Royal Commission of Inquiry (RCI) probing Sabah’s massive illegal immigrant problem, Muslim foreigners were purportedly given citizenship in exchange for their votes in order to keep the ruling government in power.

'A message from Sabah's illegal immigrants'

KOTA KINABALU: The illegal immigrants (PTI) in Sabah are sending a message to Putrajaya and the Sabah government through repeated kidnappings along the eastern seaboard by terrorist elements.

We are everywhere, we are the monster that you created, and you can’t handle us,” according to Bingkor state assemblyman Jeffrey Kitingan. “There are security risks even among the security forces,” he said.

This is Jeffrey’s take on the killing on Saturday night of a policeman in Mabul, Semporna, and the kidnapping of another policemen. Ironically, the veteran Sabah politician points out that “the latest incident comes just after the restructuring of ESSCOM and during the visit of Prime Minister Najib Tun Razak to Sabah ”.

Setting up ESSCOM is not good enough, warns Jeffrey, and wants the federal government to do something about the large presence of PTI’s in Sabah, whether they have Malaysian documents or otherwise. The crux of the problem, stressed the opposition politician whose elder brother Joseph Pairin Kitingan is a Deputy Chief Minister, is the rampant issuance of MyKads to the PTI’s.

The BN federal government has created a monster in Sabah,” reiterated Jeffrey.

This was done through the Projek IC which recruited PTI’s as Umno members and placed them on the electoral rolls as fixed deposit voters to facilitate the Malayanisation and Islamisation of Sabah.

Jeffrey is pessimistic if the federal government will ever be able to summon up the political will to send the PTI’s home.

It’s difficult to secure our borders with so many of the PTI’s having MyKads,” he alleged. “Sabah is turning into a haven for terrorists, militants and kidnappers.” The Star party Chief claimed that besides the PTI’s roaming the streets, there are some 900,000 PTI’s with “doubtful” documents in the interior who are being ignored by the authorities except when it comes to election time.

A fire in Pulau Gaya, a noted PTI concentration, last week saw 30 houses razed and 200 people made homeless and in need of resettlement,” said Jeffrey. “But the Sabah government announced that 2,000 people would be resettled in Kinarut. Where did the extra 1,800 people come from, if not from the 900,000 PTI’s in the interior?

Amaran Jeffry: Bom jangka berdetik di Sabah

Isu berkaitan kad pengenalan meragukan kepada kelompok itu, menurut Parti Reformasi Negeri (STAR Sabah), sangat membimbangkan seperti dibuktikan dalam suruhanjaya siasatan diraja untuk menyiasat pendatang haram negeri. “Semua ini telah terbukti tanpa sebarang keraguan munasabah dengan penangkapan dalam kes IC Sabah yang dipegang oleh pengawal keselamatan, pemandu teksi dan sekarang individu disyaki militan di semenanjung juga,” kata Pengerusinya Datuk Jeffrey Kitingan. “Tangkapan terbaru dua militan, dikatakan daripada Kampung Titingan di Tawau, Sabah (walaupun dinafikan ketua kampung), dan penangkapan pegawai tentera laut dan keselamatan yang disyaki berkaitan jaringan pengganas hanya sebahagian kecil daripada isu sebenarnya.” Sementara itu, Jeffry juga menyentuh pengumuman Perdana Menteri Datuk Seri Najib Razak berhubung penstrukturan semula Kawasan Keselamatan Khas Pantai Timur Sabah (Esscom). Katanya, ancaman keselamatan semasa, termasuk penculikan dan pencerobohan sempadan, disebabkan oleh dasar dan tindakan kerajaan persekutuan “membantu” pemberontak Islam di selatan Filipina “dengan cara salah mengeluarkan kad pengenalan kepada pendatang haram untuk tujuan politik”.

Reveal findings of royal commission on illegals, Sabah reps tell Putrajaya

Sabah opposition lawmakers today demanded that Putrajaya make public the Royal Commission of Inquiry (RCI) report on illegal immigrants in the state that was submitted to the Yang di-Pertuan Agong two months ago.

They said that the restructuring of the Eastern Sabah Security Command (Esscomm), as announced by Prime Minister Datuk Seri Najib Razak this morning, was not enough without a solution to the problem of illegal immigrants in the state.

"We want Najib to make known the content of the RCI report to the public. We have been waiting for two months," Bingkor assemblyman Jeffrey Kitingan told The Malaysian Insider.

Kitingan, who is also Sabah Star party chief, said the RCI would be meaningless without action and a solution to the "Project IC" problem.

He said Naib's announcement today to restructure Esscomm would also be futile if the influx of illegals was not addressed.

"In fact, it is the federal government who have made us insecure by helping Muslims in the Southern Philippines with weapons, shelter and Malaysian identity cards in exchange for their votes," he said.

Kitingan added that Putrajaya was only using Sabah as their political playground in order to control the state and its resources.

Tamparuli assemblyman Datuk Seri Wilfred M. Bumburing said he would push for the report to be tabled in the Sabah State Legislative Assembly next week.

"The people of Sabah have a right to know about the sudden and dramatic increase in the population and what the government plans to do to resolve this perennial problem," he said.

The Angkatan Perubahan Sabah president said he was aware of security issues  which may warrant some facts not to be disclosed in its totality.

"Generally we want to know whether or not the problem of foreigners having been issued with MyKad through questionable methods will be resolved.

"And the problem of state and national security, sovereignty and true independence for Sabahans in the context of Malaysia will be honoured and upheld," he added.

Bumburing, who was Upko deputy president but left the Barisan Nasional component party just before the 13th general election, said he was very certain that the memorandum he had presented to the Home Ministry was true and justified.

The former Tuaran MP had called for the home ministry to nullify all MyKad issued dubiously.

DAP Sabah vice-chairman Chan Foong Hin also urged the prime minister to release the findings of the RCI immediately and table it for debate in the coming parliament session and Sabah state assembly sitting.

Chan said the restructuring of Esscom alone would not guarantee Sabahans their safety.

"Stern action to clean up the problem of illegal immigrants with MyKad is the test for our government to prove its political will," he said.

RCI chairman Tan Sri Steve Shim Lip Kiong, who is a former chief judge of Sabah and Sarawak, had said it was up to the government to decide on the report.

“All I can say is, the public will know when the report is released,” he said after leading the RCI panel on a courtesy call to the Yang di-Pertua Negeri Tun Juhar Mahiruddin at Istana Negeri in Kota Kinabalu on May 19.

The Commission which was set up on September 21, 2012, called 211 witnesses in the proceedings which ended on Septemer 20 last year.

Among the notable witnesses were former Prime Minister Tun Dr Mahathir Mohamad, opposition leader Datuk Seri Anwar Ibrahim and former Chief Ministers of Sabah, including Datuk Harris Salleh and Datuk Seri Joseph Pairin Kitingan.

Najib announced on June 1, 2012, that Putrajaya had agreed to set up the RCI to investigate problems related to illegal immigrants in Sabah, including the issuance of Malaysian documents to Muslim illegal immigrants under a scheme known as Project IC. –  July  8, 2014.

The Royal Commission of Inquiry on illegal immigrants in Sabah was formed on 11 August 2012 to investigate the problems relating to citizenship and immigrants in the state of Sabah in Malaysia. The inquiry is closely related to Project IC, the alleged systematic granting of citizenship to foreigners.

Formation

On 1 June 2012, Prime Minister Najib Razak announced that the federal government has agreed to set up a Royal Commission of Inquiry (RCI) to investigate problems related to illegal immigration in Sabah. The Attorney-General of Malaysia was entrusted to draw the Terms of Reference (TOR) for the purpose of the commission. On 11 August 2012, the government officially announced the formation of the RCI including the members of the commission and the TORs. Political commentators have observed that the RCI appears to be a knee-jerk reaction to the defection of several prominent Sabahan BN politicians, who resigned in protest only a few days earlier because of the federal government's reluctance to deal with Sabah's immigration problems.

The commission began its public hearings on 14 January 2013.

Commission members

The commission member are as follows:

Tan Sri Steve Shim (Chairman) - former Chief Judge of Sabah and Sarawak
Datuk Saripuddin Kasim (Secretary) - Secretary General of the Domestic Trade, Cooperatives and Consumerism Ministry
Datuk Dr. Kamaruzaman Ampon (Commissioner) - former Universiti Malaysia Sabah vice-chancellor
Tan Sri Datuk Seri Panglima Herman Luping (Commissioner) - former Sabah State Attorney General
Datuk KY Mustafa (Commissioner) - former Sabah State Secretary
Datuk Henry Chin Poy Wu (Commissioner) - deputy chairman of the Malaysian Crime Prevention Foundation

Terms of Reference

There are 8 TORs:

1. To investigate the number of foreigners in Sabah given blue Malaysian ICs or citizenships;
2. To investigate if the award of such ICs or citizenships were according to the law;
3. To investigate if those given blue ICs, temporary identification receipts or citizenships through unlawful means have been registered in Sabah’s electoral roll;
4. To investigate if the authorities have taken any action or made improvements to standard operating procedures (SOPs), methods and regulations to prevent any irregularities in accordance with the law;
5. To conduct a deeper probe into the SOPs, methods and regulations on the award of blue ICs or citizenships to foreigners in Sabah by taking into consideration international norms and standards that are applicable to Malaysia, and to recommend amendments or changes to improve current practices;
6. To investigate the reasons behind Sabah’s population growth according to the following categories:
a) Sabah citizens residing in the state, including those given blue ICs or citizenships through birth certificates (late registration);
b) foreign workers (including family members);
c) illegal immigrants (including family members); and
d) fugitives
and to study their impact on the number of those registered in the electoral roll;
7. To investigate the social implications on the Sabah community following the award of blue ICs or citizenships to foreigners in the state; and
8. To investigate the number of “stateless” foreigners in Sabah given blue ICs or citizenships.

Response

Former Sabah chief minister Harris Salleh testified in the inquiry that the final authority to grant citizenship to foreigners is with the federal government. He also denied the existence of Project IC.

Former Malaysian prime minister Mahathir Mohamad admitted that Filipino immigrants were granted citizenship in Sabah, but insists that everything was done legally.

Former Sabah National Registration Department (NRD) deputy director Mohd Nasir Sugip told the commission that the former Sabah Election Commission director had ordered Sabah NRD to register 16,000 immigrants. He also added that the NRD and EC had collaborated to increase the number of Muslim voters in Sabah.

Dissident blogger Raja Petra Kamarudin wrote in Malaysia Today that there is a plot by the Barisan Nasional government to increase the Muslim population in Sabah in order to retain power in the state.

KOTA KINABALU: The fake Sabah identity cards (ICs) circulating in the peninsula are not from Sabah, claims Pakatan Pro BN, an NGO.

“Those caught with fake Sabah ICs in the peninsula are not from Sabah and have never been to the state,” says Pakatan Pro BN president Zulkarnain Mahdar.

“They obtained their fake Sabah ICs from syndicates operating outside the country,” he said.

He cited the recent example of an Indonesian with a fake Sabah IC who shot dead a woman bank employee in the peninsula. Police did not reveal from where the Indonesian obtained his fake Sabah IC.

Zulkarnain said that he wanted to challenge Star Sabah president Jeffrey Kitingan’s recent statement in the media linking the fake Sabah ICs in peninsula to Sabah.

However, he could not produce any evidence that the fake Sabah ICs detected in the peninsula came from outside the country and not from Sabah.

“It’s embarrassing to genuine Sabahans when the fake Sabah ICs in the peninsula are linked to Sabah,” said Zulkarnain. “We hope that Facebook users stop posting such news in the social media.”
